The Return of Carluccio’s: Debenhams Enters the Minefield

On 15 April 2020 Trower J heard an urgent application from the Administrators of Debenhams and gave directions.  The judge reserved judgment, but it is clear that:

  • the situation in this application had a great deal in common with the Carluccio’s matter, the judgment on which was handed down by Snowden J on 13 April 2020 [see commentary here] (including that Geoff Rowley of FRP Advisory was one of the Joint Administrators in each case); and
  • the factual matrix was sufficiently different that the outcome is likely to be far less pleasing: those differences and how the Judge deals with them are likely to be very instructive.

The judgment is eagerly awaited.  WATCH THIS SPACE.
