In the light of Manchester CC v Pinnock [2010] UKSC 45 and subsequent cases such as Thurrock BC v West [2012] EWCA Civ 1435 is there any real mileage now in an article 8 defence to a residential possession claim?

Arthur Moore and Leon Glenister discuss the continued relevance and applicability of Article 8. The seminar will therefore deal with Article 8 pleadings, the proportionality review and the importance of Article 8 up to and including execution of any possession order, not least following R (on the application of JL) v Secretary of State for Defence [2013] EWCA Civ 449.
