The first seminar deals with liquidated damages clauses in contract, and the way in which the enforceability of penalty clauses has developed since the case of Makdessi v Cavendish Square Holdings BV (also known as ParkingEye Ltd v Beavis). These clauses are commonplace in commercial contracts across a variety of different sectors, and are frequently of great significance to the outcome of a case. This seminar will discuss strategies to enforce or defeat such clauses, as well as touching upon drafting considerations.
