J2J Commercial: Upholding or defeating liquidated damages and penalty clauses in contracts

The first seminar in our J2J Commercial series will be hosted online via Zoom at 16:00 on 9 June 2020.

This seminar, hosted by Aileen McErlean, Ryan Hocking and Usman Roohani, will deal with liquidated damages clauses in contract, and the way in which the rule against penalty clauses has developed since the case of Makdessi v Cavendish Square Holdings BV (also known as ParkingEye Ltd v Beavis). These clauses are commonplace in commercial contracts across a variety of different sectors, and are frequently of great significance to the outcome of a case. This seminar will discuss strategies to enforce or defeat such clauses, as well as touching upon drafting considerations.
