Court of Appeal hands down judgment in LB Hackney v Findlay

The Court of Appeal has accepted Kerry Bretherton’s arguments in the case LB Hackney v Findlay concluding that Forcelux does not apply to residential social housing cases.   Consequently the old system of CPR 39.3 criteria applies after the execution of warrants.
