Court of Appeal decides on rent arrears possession actions

The Court of Appeal has handed down the judgment in the linked appeals of Sharples and Godfrey which will be relevant to most rent arrears based possession actions.  Kerry Bretherton of Hardwicke appeared in the Court of Appeal for the Appellant tenant in the Godfrey appeal and the appeal succeeded in so far as the Court of Appeal accepted that rent arrears which had been included in a Debt Relief Order could not be included in the money judgment.
