Court of Appeal decides on credit hire costs

23rd May 2011

Hardwicke's Jamie Clarke has successfully upheld a decision in the Court of Appeal relating to credit hire costs. The Court decided:

A judge had been entitled to make no order for costs in a successful claim for damages after a road traffic accident where the award for credit hire costs of a replacement car was severely reduced by the judge, and the claimant's conduct of the action was blameworthy because he had failed to mitigate his losses.
