Byroni specialises in all arears of property law. She has developed a strong advisory practice and frequently appears as sole counsel in County Court trials and applications and in the First-Tier Tribunal (Property Chamber) dealing specifically with service charge disputes and land registration matters.

Byroni is also developing a successful planning law practice.

Commercial Landlord & Tenant

Byroni accepts instructions to act in all types of commercial landlord and tenant disputes. She has experience of advising both landlords and tenants specifically in disputes involving, breach of covenant, forfeiture, 1954 Act business lease renewals, possession, disrepair and dilapidations.

Recent work includes:

  • Advising on the incorporation of a service charge provision into a new lease.
  • Advising on the validity of a service charge provision.
  • Advising on quantum in a disrepair claim.
  • Drafting Particulars of Claim for dilapidations of a commercial building.

Leasehold & Leasehold Management

Byroni deals with all areas of leasehold matters arising out of long residential and commercial leases acting for corporations, individuals and management companies. Byroni has experience of service charge disputes, forfeiture proceedings, enfranchisement and nuisance disputes.

Recent work includes:

  • Acting for landlords and management companies in claims for the recovery of service charge, ground rent and administration charges.
  • Acting in a one-day trial, representing an RTM concerning the validity of a loan made to the service charge account.
  • Acting in a one-day trial, representing an individual lessor on the existence of an oral variation agreement to a lease.
  • Advising on the merits of collective enfranchisement.
  • Advising on merits and quantum in disrepair cases.

Real Property & Mortgages

Byroni deals with all areas of real property including easements, restrictive covenants, adverse possession, mortgages and boundary disputes.

Recent work includes:

  • Appearing in numerous possession proceedings against trespassers.
  • Appearing on behalf of trustees in a mortgage repossession matter.
  • Advising on the validity and enforceability of restrictive covenants, specifically as to the existence of a ‘building scheme’.
  • Advising on the enforceability of a restrictive covenant preventing the construction of 200 dwellings in which the local authority granted planning permission for.
  • Advising on the enforceability and variations of rights of way.

Development & Planning

Byroni accepts instructions in all areas of planning law. Byroni has a particular interest in areas where property and planning law overlaps. Before joining Hardwicke, Byroni completed pupillage at a leading planning law set.

Byroni has experience in drafting grounds of appeal for appeals to the High Court relating to enforcement notices and applications for planning permission.

Recent work includes:

  • Drafting a statement of case for an appeal against an enforcement notice in relation to section 174 TCPA 1990.
  • Advising on the effect of a tree preservation order.
  • Advising in relation to permitted development.
  • Advising in relation to an application for a certificate of lawfulness of existing development.
