Another Hardwicke success in the Court of Appeal

Hardwicke’s Kerry Bretherton instructed by Doug Feery, of Linder Myers, represented the Appellant.  Mr. Viggers challenged the assessment of his disability by the Pensions Appeal Tribunal.  The Appellant, was unsuccessful in the Administrative Court, but the Court of Appeal allowed the appeal.  The basis of the decision was that consistency in procedural decisions was required.  Further, no proper reasons had been given why the Tribunal had assessed at 6-14% for the period up to 1995 when the assessment from 1995 onwards was 40%.
